Blekira Terms of Use (User Agreement)

1) Eligibility (17+)

The Services are intended for users aged 17 and older. By using the Services, you represent that you are at least 17 years old.

2) Your account

You may need an account to use certain features. You agree to provide accurate information (such as name, username, and email) and to keep it updated. You are responsible for maintaining the confidentiality of your account and for activities that occur under your account.

3) The services

Blekira transforms the way you capture and plan your portrait photography. Start with a simple photo import or snap, then let Blekira guide you through a world of style template choices, composition adjustments, and lighting effects tailored to your vision. Effortlessly tag scenes and add notes to create a comprehensive shooting plan, and preview your masterpiece before the shutter clicks. Collect and curate your styles, preserve your work in a local Lookbook archive, and redefine your photographic journey.

Features may change over time. We may add, modify, or remove features to improve the Services.

4) User content

"User Content" means content you submit or provide through the Services, such as photos, tags, notes, and support messages.

4.1 Ownership

You retain ownership of your User Content. These Terms do not transfer ownership of your User Content to us.

4.2 License to operate the Services

You grant Blekira Team a limited, non-exclusive, worldwide, royalty-free license to host, store (if you choose to upload), process, reproduce, and display your User Content only as necessary to provide and improve the Services and to maintain security and integrity.

4.3 Photos and faces

We do not perform facial recognition and do not use your content for biometric identification. Where server-side processing is used, it is one-time processing and uploaded content is deleted as described in our Privacy Policy.

5) Acceptable use

You agree not to:

• Use the Services in a way that violates law or infringes intellectual property or privacy rights
• Upload malicious code, attempt to probe/scan/test vulnerabilities, or bypass security measures
• Interfere with or disrupt the Services or the networks used to provide them
• Reverse engineer, decompile, or attempt to extract source code except where such restriction is prohibited by law
• Use the Services to harass, threaten, or abuse others

6) Privacy

Our Privacy Policy describes how we collect and use information. By using the Services, you acknowledge that your information will be handled as described in the Privacy Policy.

7) Intellectual property

The Services, including software, designs, text, graphics, logos, and other content (excluding your User Content), are owned by Blekira Team or its licensors and are protected by applicable laws. You may not use our trademarks without prior written permission.

8) Third-party services

The Services may rely on or interact with third-party services (for example, operating system features, app stores, or infrastructure providers). We are not responsible for third-party services and their terms and policies govern your use of them.

9) Apple App Store terms (if you downloaded from App Store)

If you downloaded the App from Apple’s App Store:

• These Terms are between you and Blekira Team, not Apple.
• Apple has no obligation to provide maintenance or support services for the App.
• In the event of any failure of the App to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price (if any) for the App; to the maximum extent permitted by law, Apple has no other warranty obligation.
• Apple is not responsible for addressing claims relating to the App, including product liability claims, claims that the App fails to conform to legal requirements, or consumer protection claims.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce these Terms against you as a third-party beneficiary.

10) Disclaimer of warranties

The Services are provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

11) Limitation of liability

To the maximum extent permitted by law, in no event will Blekira Team be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of (or inability to use) the Services.

To the maximum extent permitted by law, Blekira Team’s total liability for any claim arising out of or related to the Services will not exceed the amount you paid (if any) to use the Services in the twelve (12) months before the event giving rise to the claim.

12) Indemnification

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Blekira Team from and against claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Services or your violation of these Terms.

13) Termination

You may stop using the Services at any time. We may suspend or terminate your access to the Services if we reasonably believe you violated these Terms or if necessary to protect the Services, users, or our rights. Upon termination, your right to use the Services will stop.

14) Governing law

These Terms will be governed by the laws of the jurisdiction where Blekira Team has its principal place of business, without regard to conflict of law principles.

15) Dispute resolution and binding arbitration

Except where prohibited by law, any dispute, claim, or controversy arising out of or relating to the Services or these Terms will be resolved by binding arbitration administered by a reputable arbitration provider, and not in court. You and Blekira Team waive any right to a jury trial and any right to participate in a class action, class arbitration, or representative action, to the maximum extent permitted by law.

16) Changes to these terms

We may update these Terms from time to time. We will post the updated Terms and revise the Effective Date above. Your continued use of the Services after changes become effective means you accept the updated Terms.
